With the decision, plans are not required to pay for procedures that are not covered by the list of therapies approved by the agency.
“The decision of the STJ is adequate. The List of Procedures and Events in Health must be exhaustive”, he told the column.
Queiroga said that Law 14,307, enacted in March this year by President Jair Bolsonaro and which created the Commission for Updating the List of Procedures and Events in Supplementary Health, will help to correct the delay that existed for the evaluation of new procedures that should be included in the coverage by health plans.
“The amendment of the Supplementary Health legislation, which created the process of evaluating the incorporation of technologies in this area, corrects the delay that existed previously and ensures the proper updating of the list”, said Queiroga.
According to the minister, the decision of the STJ will ensure that the plans are offered “with values compatible with people’s ability to pay”. “Today the process of incorporation (in the list) is more transparent and provided for by law”.
The minister also said that, due to current legislation, the list must include “evidence-based” medical needs. “The law guarantees that incorporations (in the ANS list) meet safety, effectiveness and cost/effectiveness criteria,” he said.
