Violation 1. Drove into the “closed” forest

In the Forest Code of the Russian Federation there is an article 53.5, according to which local (regional or district authorities) can at any time prohibit the entry of cars into a particular forest due to an unfavorable fire situation.

Which is quite justified: a heated exhaust system of a car can easily cause a fire. At the same time, the territory itself is declared a zone in which a special fire safety regime operates.

Sanction. Article 8.32 of the Code of Administrative Offenses of the Russian Federation (“Violation of fire safety rules in forests”) was seriously tightened in mid-2022. Now, according to part 3 of Art. 8.32 of the Code of Administrative Offenses of the Russian Federation for “Violation of fire safety rules in forests under a special fire regime, an emergency regime in forests resulting from forest fires” a fine of 40,000 to 50,000 rubles (previously 3,000-5,000 rubles) may be imposed on an individual .

Fines can be issued by both employees of the Ministry of Emergency Situations and employees of forestry and water management.

How to avoid. Check on the website of the local administration or on the website of the regional department of the Ministry of Emergency Situations whether a special regime has been introduced. In theory, information boards should warn about a ban on the entry of motorists, but in reality they are not installed everywhere and not always.

Violation 2. Too lazy to leave the city

Special rules of conduct apply in the so-called Forest Park Green Belt (LPZP). These forests are located within the city limits and around the city, creating a single ecological system with it.

Sanction. The fine for “burning forest combustible materials” in violation of fire safety rules on the territory of the “green belt” for citizens is from 40,000 to 50,000 rubles; for officials – from 50,000 to 80,000 rubles; for legal entities – from 500,000 rubles to 1 million rubles (part 2.1, article 8.32 of the Code of Administrative Offenses of the Russian Federation).

How to avoid. Check if the selected location is a PAP (this information is usually posted on the city administration website). Familiarize yourself with the rules of conduct in such a territory.

Violation 3. Threw garbage out of the car

In July 2022, in the “garbage” st. 8. 2 of the Code of Administrative Offenses of the Russian Federation, parts 3.1-3.4 were introduced, which increased the fines for polluting the environment by motorists by almost 10 times (see Federal Law of July 14, 2022 N 287-FZ). Otherwise, unfortunately, it is impossible to fight the barbaric littering of roads and roadsides.

Sanction. Now, a citizen will have to pay a fine from 10,000 to 15,000 rubles for unloading or dumping waste from a car or trailer outside the places of accumulation of garbage (part 3.1 of article 8.2 of the Code of Administrative Offenses of the Russian Federation). For the repeated commission of this offense, you will have to say goodbye already with an amount of 20,000 to 30,000 rubles (part 3.2 of article 8.2 of the Code of Administrative Offenses of the Russian Federation).

If the garbage was thrown from a truck, a trailer to it, a tractor or “other self-propelled vehicles”, the fine for the first violation for an individual will be from 40,000 to 50,000 rubles (part 3.3 of article 8.2 of the Code of Administrative Offenses of the Russian Federation). If repeated – from 60,000 to 70,000 rubles (part 3.4 of the Code of Administrative Offenses of the Russian Federation).

How to avoid. Throw garbage in the trash, not along the roads.

Violation 4. Stopped on the shore

In most cases, it will not work to come to a coast untouched by civilization and settle down near the water. The Water Code prohibits the movement and parking of private cars in the water protection zone on roads that do not have a hard surface.

Now, if an asphalted or gravel-filled area is equipped on the shore, park to your health. The track, even tightly “rammed down” by vacationers like you, is not a paved road.

How far from the water will you have to “drop” the car? This depends on the width of the water protection zone, which in turn is determined by the size of the river:

– streams and rivers up to 10 km long cannot be approached closer than 50 meters;

– to rivers with a length of 10-50 km – closer than 100 meters;

– to a river with a length of more than 50 km – closer than 200 meters;

– from the sea, the car must be left 500 meters away.

Sanction. The owner who left the car on the shore will be fined from 3,500 to 4,000 rubles under Art. 8.42 of the Code of Administrative Offenses for “the use of the coastal protective strip of a water body, the water protection zone of a water body in violation of restrictions on economic or other activities.”

This sanction has not been tightened this year, but it has become much more common.

How to avoid. If you know that there are no paved roads near the reservoir, check if the site you have chosen is not a water protection zone. This can be done on the site with a public cadastral map.

Violation 5. Turned into a reserve

Unauthorized entry of a private car into the territory of a reserve or reserve, national or natural park is considered by law as a violation of the established regime for the use of the environment and natural resources.

Sanction. Article 8.39 of the Code of Administrative Offenses of the Russian Federation provides for a fine of 3000-4000 rubles for such a violation. But this is half the trouble. This article allows for the confiscation of “instruments for committing an administrative offense.”

Is it possible to evacuate the car? According to lawyers, there are attempts (albeit few in number). But the confiscation of any property can be made only by a court decision.
