Volkswagen was unable to “translate” GAZ’s claim for consideration in an international court

The arbitral tribunal denied the defendant’s application.

The Volkswagen concern was denied in the Arbitration Court of the Nizhny Novgorod region to leave without consideration a claim from GAZ in the amount of 28.4 billion rubles. The representative of VW AG petitioned to leave the claim without consideration in order to resolve the dispute in an international court.

The representative of the German automaker pointed out that the agreement provides for the possibility of dispute resolution in the ICC – the International Chamber of Commerce, with a place of resolution in Geneva. This could “exclude the jurisdiction of the arbitration courts of the Russian Federation,” the petition notes.

In turn, a representative of the Gorky Automobile Plant called the petition of the former partner “surprising in nature”, recalling that the GAZ Group is now under US and EU sanctions, and the automobile plant is a subsidiary of the Group. Thus, the Russian company will not have any opportunity for judicial protection, the representative of the plaintiff noted.

A hearing in the case has been scheduled for July 17.
